On February 22, a New York federal judge ruled that Dapper Labs’ NBA Top Shot Moment NFT Collection is ‘plausibly’ a security as the existence and success of these NFTs are guaranteed if and only if Dapper Labs’ private blockchain and its native token FLOW still remain. Therefore purchasing any piece of the Top Shot NFTs means rooting for Dapper Labs; and this connection appears to fall under the U.S. federal law’s definition of a security. And SEC Chair Gary Gensler said in an interview with NYMAG on February 23 that ‘everything other than Bitcoin is a security’.
