Custodial sub-account disclaimer
Investor (hereinafter referred to as "you").
The custodial sub-account feature is designed to meet investors' asset management needs by allowing users to entrust their funds to a professional delegated trader. Note that the custodial sub-account feature is a service for you to establish a delegation relationship with a professional delegated trader. Bitget solely acts as a trading platform to enable delegation for both parties (you and the delegated trader). Bitget does not participate in the formulation of the agreement or the resolution of disputes between the parties (you and the delegated trader). For the avoidance of doubt, Bitget does not enter into any legal relationship with you or any of the delegated traders regarding the custodial sub-account feature.
When using this feature, it is your responsibility to exercise your own judgment and determine whether it is suitable for your needs. When entering into a delegation agreement with a delegated trader, it is your responsibility to independently assess the safety, reliability, authenticity, and trading abilities, among other capabilities, of the delegated trader. Bitget does not perform any vetting or background checks on the delegated trader. The Bitget platform makes no representation or warranty regarding the availability, reliability, or suitability of the custodial sub-account feature. By clicking on the I have read and understand, you acknowledge and accept all the rules of the Bitget custodial sub-account. Furthermore, you explicitly agree that all risks and potential losses associated with the use of the custodial sub-account shall be borne solely by you.
You understand and acknowledge that Bitget is not responsible for the operation of the custodial sub-account feature or the results thereof. You understand that Bitget cannot guarantee the services it provides to be free of defects. Hence, you agree that any potential defects in the services provided by Bitget shall not be considered a breach of contract by Bitget. You agree to cooperate with Bitget in resolving such defects. The custodial sub-account feature enables you to grant full or partial operational authority over your services to one or more authorized accounts of your delegated trader. Under such circumstances, any actions carried out under the authorized account(s) will be considered as your own actions conducted through your own account, and you shall assume all responsibilities and fees arising therefrom.
You understand and acknowledge that Bitget will provide you with related features and services for the management and monitoring of certain services. Although Bitget conducts detailed testing on these services, it cannot guarantee full compatibility with all software and hardware systems, nor can it guarantee the complete accuracy of its software and services. In the event of incompatibility and software errors, you should immediately disable or discontinue the use of the relevant features and contact Bitget for technical support.
You understand and acknowledge that Bitget shall not be held liable for any issues that may arise during the delegation process, including, but not limited to, any indirect, incidental, special, or consequential damages (including, but not limited to, loss of profits), or any trading disputes arising from the use of the custodial sub-account.
You understand and acknowledge that, to the maximum extent permitted by law, Bitget is not liable for any consequential, incidental, indirect, exemplary, special, or punitive damages, whether for breach of contract by the parties (you and the delegated trader), or otherwise, whether or not such damages are foreseeable and whether or not you have been informed of the possibility of such damages. Always do your own research before delegation.
Bitget reserves the right to modify or update the rules of the custodial sub-account feature from time to time and to suspend the service at any time if necessary. By continuing to use the custodial sub-account feature, you agree to abide by and accept the latest rules and disclaimers.
The disclaimer may be translated into multiple languages. For all interpretations, the English version shall prevail.
