API Key Terms of Use

The API Key Terms of Use (or "Terms") apply to your use of API keys on the Bitget platform.
This Agreement shall be deemed effective once you have begun using the API keys, or you have acknowledged your acceptance of the Terms of Use, you have received a notice under the Terms (as determined by Bitget, including clicking on
Agree or any other fields related to the Terms).
In the event of any conflict or inconsistency between the Terms and other Bitget terms of use, these Terms shall prevail in relation to the following services unless expressly stated otherwise.
1. Definitions
API Key
As a unique identifier (using API keys, public keys, private keys, or digital signatures), an API key allows its holder to programmatically access Bitget accounts and related features of the Bitget platform. You are solely responsible for ensuring the security, confidentiality, and proper use of your API keys in accordance with applicable laws. You can generate multiple API keys with different access levels and permissions on Bitget.
You acknowledge that Bitget is not liable for any activities that occur under any API keys used or generated by you, including but not limited to unauthorized access, use of your account, data breaches, and loss of funds. You are solely responsible for any loss arising from any transaction initiated through an API key used or generated by you.
You shall implement appropriate technical and security measures to protect your API keys from loss, theft, hacking, and unauthorized disclosure or access. You must report any API key loss and suspected or actual misuse to Bitget immediately.
You acknowledge and agree that you are solely responsible for the execution of any operations or instructions using API keys and that neither Bitget nor its affiliates are liable for any losses arising from such operations or instructions. You acknowledge and agree that Bitget may share or allow access to your personal data based on your actions and instructions.
You also acknowledge that anyone accessing your account using the API keys assigned to you is authorized to do so on your behalf and that you are solely responsible for any consequences arising therefrom. Bitget may legitimately suspend an API key of yours if we have appropriate reasons to believe that the security of the API key has been compromised.
Bitget technology
The API keys and any proprietary technologies of Bitget, including but not limited to any software, processes, scripts, algorithms, user interfaces, know-how, designs, and other tangible or intangible technical materials or information provided by Bitget to you during the validity of the Terms, and all updates and intellectual property rights therein.
Intellectual property
Patents, rights to inventions, copyrights, neighboring and related rights, tradem arks and service marks, business names and domain names, rights in appearance and trade dress, goodwill and the right to sue for counterfeiting or unfair practices, design rights, computer software rights, database rights, the right to use confidential information and maintain its confidentiality (including proprietary technologies and trade secrets), and all other intellectual property rights (whether registered or unregistered, and including all applications and rights granted by applications), renewals or extensions thereof and rights to claim priority, and all similar or equivalent rights which may exist now or will exist in the future.
Sanctions
Any economic or financial sanctions or trade embargoes imposed, administered, or enforced by any sanctioning authority.
Sanctioning authorities
Any main authorities imposing sanctions, including the United States, the United Kingdom, the European Union, any European Union member state, the United Nations, and the United Nations Security Council, as well as any governmental entity of any such sanctioning authority, such as the U.S. Department of State, the U.S. Office of Foreign Assets Control, and the UK's HM Treasury.
2. Permission to use API keys
Subject to the scope of the Terms, Bitget hereby grants you an individual, time-restricted, limited, and revocable right and permission that cannot be sub-licensed, transferred, or exclusively authorized to others to integrate API keys with Bitget and to use the Bitget platform in ways specified by Bitget and in compliance with applicable laws. Bitget reserves all rights not expressly outlined in these Terms.
The permission to use API keys granted by these Terms is contingent upon your compliance with the following conditions and the responsibilities outlined herein.
You may not, directly or indirectly, during or after the validity period of these Terms:
Reverse engineer or disassemble API keys or API-related data, or attempt otherwise to discover the source code, underlying structure, inventions, algorithms, know-how, or ideas (collectively the "source material") of the API keys or API-related data, except where reverse engineering is prohibited only if it violates applicable laws.
Modify or translate API keys or API-related data, or otherwise create derivatives, improvements, modifications, enhancements, or extensions to the API keys or API-related data in any form without written authorization from Bitget.
Access or seek to access (including seeking access methods) any personal data controlled by Bitget.

Fail to use API keys in accordance with these Terms or other written instructions from Bitget and all applicable laws, regulations, and applicable sanctions.

Unless specially permitted under these Terms, otherwise use or exploit API keys or API-related data in any manner for any purpose.

Challenge (whether in court or by way of interference, appeal, or otherwise) Bitget's intellectual property rights over Bitget's technologies as licensed under these Terms.

Grant or attempt to grant a security interest in or otherwise restrict API keys or API-related data.

Use API keys for any unlawful or malicious purpose, including but not limited to using API keys for market manipulation, insider trading, front-running, pumping and dumping, wash trading, or fraud.

Permit or assist any third party to perform any of the above acts.

Your access to our website or use of any of the services offered on the website shall not be deemed to be an assignment by us of any intellectual property rights to you.
3. Risks
You acknowledge and agree that there are certain risks associated with the use of API keys and that it is your responsibility to ensure that the API keys are not shared with any third party with whom you do not wish to share control of your Bitget account. For the avoidance of doubt, you agree to treat your API keys as passwords, and you agree not to inadvertently or intentionally disclose your API keys. You acknowledge that you are solely responsible for any risks and potential losses arising from the use of API keys, including but not limited to unauthorized access, data breaches, and loss of funds. Neither Bitget nor its affiliates are liable for any loss or damage arising from the use of API keys. You are solely responsible for managing your API keys and securing your account by measures including but not limited to:

Using an API key for a single purpose or application only.

Only enabling API key permissions on the basis of necessity.

Not enabling any unused API keys and instantly deleting any and all unused API keys.

Adopting an IP address whitelist for all API keys to block access from any unnecessary IP addresses.

Refraining from placing your API keys directly into publicly available or insecure source code or repositories.

Not storing your API keys anywhere on the cloud.

Not sharing your API keys with any third party with whom you do not wish to share control of your Bitget account.

Using RSA key pairs for security hardening.

When you believe an API key is at risk or is compromised, deleting it and generating a new one.
4. Authorization
By using API keys, you send programmatic instructions to Bitget based on your API key permissions. You acknowledge and agree that you are solely responsible for the execution of any operations or instructions using your API keys and that Bitget (nor its affiliates, assignees, etc.) is not liable for any losses or damages arising from such operations or instructions. You also acknowledge and agree that Bitget may share or allow access to your personal data based on your actions and instructions.
5. Cancelation
Bitget reserves the right to cancel or disable the use of API keys at any time without prior notice at its sole discretion and without reason. You may cancel or disable any API keys authorized to you at any time in accordance with the procedures specified by Bitget.
6. Limited Liability
Bitget is not liable for any indirect, incidental, exceptional, or consequential damages (including but not limited to losses in profits) arising from the use of API keys.
In addition, to the maximum extent permitted by law, Bitget is not liable for any consequential, incidental, indirect, exemplary, exceptional, or punitive damages, whether for breach of contract, tort (including negligence), or otherwise, whether or not such damages are foreseeable and whether or not you have been informed of the possibility of such damages.
Bitget's liability shall be further limited as outlined in these Terms.
7. Compensation
If Bitget and/or any Bitget affiliate's directors, managers, or employees suffer damages as a result of any breach by you (or your authorized users) of any of your obligations under these Terms or any violation of any applicable laws, sanctions, regulations, or any misconduct during the course of use of the services provided hereunder, then, without prejudice to any other rights Bitget may have under law, you shall be fully liable to Bitget and/or its affiliate's directors, officers, and employees.
Without limiting the foregoing, you agree to defend Bitget and its affiliates and/or their respective directors, managers, employees, and agents ("Protected Parties") against all third-party claims to the fullest extent permitted by applicable laws. You shall be fully liable for any administrative order or lawsuit arising out of your use or misuse of API keys ("Claims"). You shall also compensate any costs, losses, or damages suffered by the indemnified party as a result of any such claim, including reasonable costs of legal proceedings and defense.
8. Termination
Bitget has the right to terminate these Terms at any time. After the termination:

You must immediately terminate all rights and permissions granted to you under the Terms, return them to Bitget, and cease accessing and using the API keys.

Bitget shall not be liable for any damages, losses, or expenses of any kind suffered or incurred by other parties as a result of the termination of the Terms (or any part thereof), whether or not either party is aware of such damages.
9. Operations
Bitget does not guarantee that the API key operations will be uninterrupted or completely error-free. Bitget also does not guarantee the accuracy, suitability, reliability, integrity, or performance of API keys. You agree to use API keys at your own discretion and risk.
10. Applicable Laws
When using API keys, you shall comply with applicable laws and assume all applicable obligations under these Terms.
You must not cause Bitget to violate any applicable laws or obligations under any regulatory authority. You shall provide all support and information related to the use of the API keys in order for Bitget to fulfill all of its obligations under any applicable laws or regulatory authority.
You must not allow any access to the Bitget platform from Iran, North Korea, or any other sanctioned countries.
At any time, upon Bitget's reasonable request, you shall certify in writing to Bitget that you are in full compliance with your obligations under the Terms and provide legitimate evidence of compliance.
11. Modification
Bitget reserves the right to modify these Terms at any time and will disclose such modifications through its website. No additional notice will be provided. It is your responsibility to check the Terms regularly for changes. The continued use of API keys after any such modifications constitutes acceptance of the revised terms and conditions.
12. Entire Agreement
Bitget reserves the right to the final interpretation of the Terms. The foregoing terms and conditions constitute the entire agreement between you and Bitget with respect to the use of API keys and, unless otherwise agreed, supersede all prior or contemporaneous communications and proposals, whether oral or written, between you and Bitget.
